Agreement to Terms

By accessing or using CharityGolfEvent.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

Description of Service

CharityGolfEvent.com provides a SaaS platform for organizing and managing charity golf events, including tools for event setup, player management, team generation, registration, payment processing, check-in, live scoring, leaderboards, sponsor management, communications, and reporting.

Account Registration

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

Pricing and Payment

Event-Level Pricing

CharityGolfEvent.com uses event-level pricing. Different features and capabilities are available at different plan tiers (Free Planner, Registration, Pro Event, Signature Event). Current pricing is available on our pricing page.

Platform Fees

When you process payments through the Platform (registrations, donations, auctions, raffles), we charge a platform fee as a percentage of the transaction amount. Platform fees vary by plan tier and are disclosed before you activate paid features. Payment processing fees charged by our payment partners (Stripe) are separate and apply in addition to platform fees.

Payment Processing

To accept payments, you must connect a Stripe Connect account. You agree to comply with Stripe's terms of service and our payment processing requirements. We use Stripe Connect's application_fee_amount mechanism to collect platform fees from your transactions.

Refunds

Platform fees for activated event upgrades are generally non-refundable. You are responsible for managing refunds to your event participants and donors in accordance with your own refund policies.

Acceptable Use Policy

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Violate any laws, regulations, or third-party rights
  • Upload or transmit viruses, malware, or malicious code
  • Attempt to gain unauthorized access to the Platform or related systems
  • Interfere with or disrupt the Platform or servers
  • Use automated systems (bots, scrapers) without our permission
  • Impersonate any person or entity
  • Collect or harvest user information without consent
  • Use the Platform to transmit spam or unsolicited communications
  • Engage in fraudulent or deceptive practices

Your Content and Data

Ownership

You retain ownership of all content and data you upload to the Platform (event details, player information, images, etc.). You grant us a license to use, store, and display your content as necessary to provide the Platform services.

Responsibility

You are responsible for ensuring you have the necessary rights and permissions to upload and use all content, including player information, sponsor logos, and images. You agree to comply with applicable data protection laws, including obtaining necessary consents from event participants.

Public Event Information

Information you publish through public event pages (via /e/[eventSlug] URLs) is accessible to anyone with the link. Do not publish sensitive or private information through public event pages.

Intellectual Property

The Platform, including its original content, features, and functionality, is owned by CharityGolfEvent.com and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Platform without our express permission.

Third-Party Services

The Platform integrates with third-party services including Stripe (payments), Vercel (hosting), Supabase (database), and Resend (email). Your use of these services is subject to their respective terms of service. We are not responsible for the availability, functionality, or policies of third-party services.

Disclaimers and Limitation of Liability

Service "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, CharityGolfEvent.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption arising from your use of the Platform.

Maximum Liability

Our total liability to you for all claims arising from your use of the Platform shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless CharityGolfEvent.com and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Platform, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) your content and data.

Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease.

Data Backup and Export

While we implement regular backups, you are responsible for maintaining your own backups of critical data. We provide data export functionality to help you maintain copies of your event information.

Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where CharityGolfEvent.com is registered, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CharityGolfEvent.com regarding use of the Platform and supersede all prior agreements and understandings.
